General Terms and Conditions

Scope
These terms and conditions apply to contracts and confirmations concerning the provision of conference, banquet, and event rooms as well as all table reservations at Restaurant Ackermannshof. -
Conclusion of Contract

The contract is concluded as soon as the rented tables, rooms, areas, and other deliveries and services have been confirmed by Restaurant Ackermannshof in writing.

When conference, banquet, and event rooms are rented, all related additional services and deliveries by Restaurant Ackermannshof also become part of the contract.

The subletting or further letting of the provided rooms, areas, or items for events by the customer requires the prior written consent of Restaurant Ackermannshof. This also applies to the publication of event notices in the form of newspaper advertisements, etc., insofar as Restaurant Ackermannshof is mentioned therein.

Services, Prices and Payments

Restaurant Ackermannshof is obliged to provide the ordered and confirmed service in writing.

The customer is obliged to pay the agreed prices for these services. This also applies to services and expenses of Restaurant Ackermannshof to third parties related to the event.

The agreed prices include the applicable statutory VAT. If the period between contract conclusion and contract fulfilment exceeds 8 months and the price generally charged by Restaurant Ackermannshof for such services increases, the agreed price may be reasonably increased – but by no more than 10%.

Restaurant Ackermannshof is entitled to request a reasonable advance payment at any time. The amount of the advance payment and the payment dates can be agreed in writing in the contract. If the advance payment is not made even within a set reasonable grace period, Restaurant Ackermannshof is entitled to withdraw from the contract according to clause 4.

Withdrawal by Restaurant Ackermannshof

If an advance payment demanded under clause 3.4 is not made even after the expiry of a reasonable grace period set by the restaurant, the restaurant is entitled to withdraw from the contract.

Restaurant Ackermannshof is also entitled to withdraw from the contract for other objectively justified reasons. For example:

In cases of force majeure, when it was impossible to fulfil the contractual obligation considering the circumstances and exercising the required care.

For events booked under misleading or false information of essential facts, e.g., about the organiser or the purpose.

Where there is justified reason to believe that the event could endanger the smooth business operation, safety, or reputation of the restaurant in public.

In case of violations against the notification of subletting or further letting.
-

Restaurant Ackermannshof must inform the customer immediately about the exercise of the right of withdrawal.

If the performance becomes impossible or partially impossible for Restaurant Ackermannshof, the parties will, if possible, agree on another date and/or event location. If such an agreement is not possible, already paid fees for agreed or booked services will be refunded.

Cancellation by the Customer
- Cancellations and changes require written form. The decisive factor is the receipt of the cancellation by Restaurant Ackermannshof.
- For booked services (e.g., table reservations with an agreed fixed menu, event packages, conference flat rates, room rentals, rented technical equipment, etc.) the following table applies:
- Table Reservations in the Restaurant
- If a a-la-carte table reservation is a no-show, CHF 150 per registered person will be charged.
- For table reservations with a pre-agreed menu or food and drink package, a reduction of up to 10% of the number of persons and up to 2 days before the event is free of charge.
- If the reduction exceeds 10%, the difference will be charged.
- If the notification is made less than 2 days before, the last reported number of participants will be charged.
- If the originally communicated number of participants is exceeded, the actual number of participants will be charged.
- Events in the Restaurant or the Banquet Hall (Banquet, Seminar)

Loss or Damage of Brought Items

Exhibition or other items, including personal belongings, brought along are at the customer's risk in the event rooms or in the restaurant. The restaurant assumes no liability for damage or loss.

Brought decoration materials must comply with fire safety regulations. The restaurant is entitled to request official proof of this. To avoid possible damage, the attachment or placement of items must be coordinated with Restaurant Ackermannshof in advance.

Brought exhibition or other items must be removed or taken away immediately after the event. If the customer fails to do so, the restaurant is entitled to remove and store them at the customer's expense.

Liability of the Customer
7.1) The customer is liable for all damages to the building or inventory caused by themselves, event participants or visitors, employees, or other third parties from their area.
7.2) The customer is obliged to inform Restaurant Ackermannshof in good time about any damage.

8) Final Provisions

8.1) Changes or additions to the contract must be made in writing. Unilateral changes or additions by the customer are invalid.

8.2) Place of performance and jurisdiction is the location of Restaurant Ackermannshof, 4056 Basel; exclusively Swiss law applies.

8.3) Should individual provisions of this agreement be invalid or void, this shall not affect the validity of the remaining provisions. Otherwise, the statutory provisions in Switzerland apply.
